ORDER ADOPTING REPORT AND RECOMMENDATIONS: Accordingly, IT IS HEREBY ORDERED that defendant's motion to dismiss is granted and the complaint is dismissed with leave to amend in accordance with the R&R and this Order. Plaintiff shall submit an amended complaint within 45 days of the date of this Order.
