Filing 77 ORDER: For the reasons stated in the attached Memorandum and Order, the Court finds that it does not have subject matter jurisdiction over this matter. Accordingly, the Court grants Defendants' motion in its entirety. Additionally, the Court d enies Plaintiff's motion to amend, but grants him leave to amend his FDCPA, RESPA, TILA, and/or § 487 claims, if he has a good faith basis for doing so. As these claims only relate to Defendant SPS, the Court terminates Defendants Assurant Inc. and ASIC as parties from this action. Plaintiff shall file his amended complaint within ninety (90) days from the date of this Order. Plaintiff is advised that the amended complaint will completely replace the original complaint, must be capt ioned "Amended Complaint," and shall bear the same docket number as this Memorandum and Order. All further proceedings shall be stayed for 90 days or until further Order of the Court. If Plaintiff fails to file an amended complaint within the time allowed, the Court will enter judgment dismissing this action. Ordered by Judge Pamela K. Chen on 4/22/2020. (Larson, Emma) |
