September 18, 2018 Opinion or Order Filing 20 ORDER ADOPTING REPORT AND RECOMMENDATIONS IT IS HEREBY ORDERED that NUMC's motion to dismiss (Dkt. No. 14) is granted, and that plaintiff's complaint is dismissed without prejudice. The Court grants plaintiff leave to submit an amended comp laint to address the issue of the timeliness of his initial complaint, as discussed in the R&R. Plaintiff's amended complaint must be submitted within forty-five (45) days from the date of this Order. The Court warns plaintiff that failure to su bmit an amended complaint will result in dismissal of the case with prejudice for failure to prosecute. IT IS FURTHER ORDERED that counsel for NUMC shall serve a copy of this Order on plaintiff and file proof of service with the Court. The Court cert ifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal.
