MEMORANDUM OF DECISION & ORDER: On July 27, 2018, the Plaintiff moved for a default judgment against the Defendant pursuant to Federal Rules of Civil Procedure ("Fed. R. Civ. P." or "Rules") 37 and 55 due to the Defendant's failure to comply with a number of orders issued by United States Magistrate Judge A. Kathleen Tomlinson. The Court referred the Plaintiff's motion to Judge Tomlinson for a report and recommendation. For the foregoing reasons, the Court overr ules the Defendant's objections and adopts the 20 R&R in its entirety. The Court denies the Plaintiff's 17 motion for entry of default judgment. Pursuant to Rule 37, the Court awards the Plaintiff's Counsel attorney's fees and costs for the total amount incurred in connection with filing the motion for default judgment. The Plaintiff's Counsel is directed to submit a memorandum, with accompanying affidavits and other appropriate documents, regarding the amount to be reimbursed no later than 30 days from the issuance of this Order. The Defendant's counsel must file any objections to the amount requested no later than 14 days from the filing of the Plaintiffs Counsels memorandum. SEE ATTACHED DECISION for details.
