Filing 39 ORDER ADOPTING REPORT AND RECOMMENDATIONS - For the reasons set forth above, Wheat's objections are overruled, the Report is accepted in its entirety and, for the reasons set forth in the Report, Wheat's motion to dismiss plaintiff's c laims against him pursuant to Rule 12(b)(2) and 12(b)(3) of the Federal Rules of Civil Procedure, or, in the alternative, to transfer this action to the United States District Court for the Southern District of California pursuant to 28 U.S.C. § 1404(a), is denied in its entirety. In light of this determination, the stay of discovery previously granted by this Court is vacated; this matter is respectfully referred to Magistrate Judge Tomlinson for discovery and all pretrial matters; all dis covery shall be completed by no later than 9/3/2019; and the status conference scheduled to be held before the undersigned on 3/18/2019 is adjourned to 9/18/2019 at 11:15AM in Courtroom 1010 at the Central Islip Courthouse.
