March 31, 2021 Opinion or Order Filing 74 MEMORANDUM AND ORDER: For the foregoing reasons, defendants' motion for summary judgment is denied in part and granted in part. The Court denies summary judgment on both the FLSA and NYLL overtime claims. The Court also denies the defendants&# 039; motion for summary judgment as to plaintiffs claim under NYLL § 195(3), for paystub violations. The Court grants defendants motion for summary judgment as to plaintiffs claim under 195(1) and claim of retaliation under NYLL §215. The Court grants Quartararo's motion for summary judgment on the issue of overtime compensation under both the FLSA and the NYLL, but denies the rest of plaintiffs' motion.
