CIV. P.) 12(b)(6). For the following reasons, the Defendants 4 motion is d enied. As N.Y. C.P.L.R. § 901 does not control here because the Defendant removed this action to federal court, and that is the sole basis upon which the Defendant moves, the Defendants motion to dismiss the complaint pursuant to Rule 12(b)(6) is denied.
