MEMORANDUM OF DECISION & ORDER: For the reasons stated above, the Defendants 11 motion to dismiss the Plaintiffs complaint pursuant to Rule 12(b)(6), is granted. The Plaintiffs first cause of action is dismissed without prejudice with leave to replead. The Plaintiff is required to serve his amended complaint within thirty days from the date of this order.
