ORDER granting #9 Motion for Interpleader Deposit (28 U.S.C. Section 1335) - IT IS HEREBY ORDERED THAT: 1. Plaintiff shall deposit the sum of $358,617.75 into the Disputed Ownership Fund of the Court pursuant to 28 U.S.C. 1335 and Local Civil Rule 67.1, within 10 business days of the entry of this Order, by check payable to Clerk of Court, U.S. District Court, EDNY, which check shall also indicate the case name and caption of this action. 2. The Clerk of Court shall deposit such funds into the Disputed Ownership Fund of the Court in an interest-bearing account pursuant Local Civil Rule 67.1(c). 3. The Clerk of Court shall deduct from the income on the investment a fee consistent with that authorized by the Judicial Conference of the United States and set by the Director of the Administrative Office. 4. Income generated from fund investments shall be distributed after the appropriate fee has been applied and tax withholdings have been deducted from the fund. SO Ordered by Judge Sandra J.
