December 10, 2018 Opinion or Order ORDER granting #2 Motion for Leave to Proceed in forma pauperis. Upon review of the in forma pauperis application, the Court finds that plaintiff's financial status qualifies plaintiff to commence this action without prepayment of the filling fee. See 28 U.S.C. 1915(a)(1). Accordingly, plaintiff's application to proceed in forma pauperis is granted. The United States Marshals Service for the Eastern District of New York is directed to serve the complaint on defendant. Defendant shall serve the administrative record on plaintiff by March 12, 2019, but shall not file the record on ECF until the motion is fully briefed. Defendant shall serve a motion for judgment on the pleadings by May 13, 2019. Plaintiff shall serve a response to Defendants motion, and any cross-motion, by July 12, 2019; and Defendant shall serve its reply and file the fully briefed motion, including the administrative transcript, on ECF, by August 12, 2019.
