ORDER re #5 Motion for Pre Motion Conference. The Court waives its pre-motion conference requirement and grants defendants' request to file a motion to dismiss. Defendants shall serve their opening brief on plaintiff by March 22, 2019. Plaintiff shall serve his opposition by May 3, 2019. Defendants shall serve their reply, and file the fully briefed motion in accordance with the Court's individual rules, by May 24, 2019. ORDER: On December 20, 2018, defendants filed a letter requesting a pre-motion conference concerning a proposed motion to dismiss. My individual rules require parties to respond to pre-motion conference letters within seven days. If plaintiff still intends to prosecute this lawsuit, he must, by January 29, 2019, either (1) file his opposition to defendants pre-motion conference letter, or (2) indicate by letter to the Court that plaintiff does not wish to file an opposition but still intends to prosecute this lawsuit. Failure to respond to this Order may result in the dismissal of this action pursuant to Federal Rule of Civil Procedure 41(b).
