Filing 97 CERTIFICATE OF SERVICE by Margaret Shakespeare re Status Report Order,,,,,, (Tusa, Joseph) |
STATUS REPORT ORDER: On May 13, 2019, this Court granted defense counsels' motion to withdraw as attorneys of record for Defendant Live Well Financial, Inc. The Court further ordered that Defendant Live Well Financial, Inc. was to obtain new counsel by June 13, 2019, and that new counsel enter a notice of appearance by June 13, 2019, as a corporate entity is not allowed to continue in a federal litigation unrepresented. Defendant Live Well Financial, Inc. was also advised that failure to have a notice of appearance entered by June 13, 2019 or failure to communicate with this Court advising why no such notice of appearance could be entered by that date, may result in this Court's recommendation to the District Court that an order of default be entered. A review of the docket reflects that to date, no notice of appearance or communication on behalf of Live Well Financial, Inc. has been entered on the docket. Accordingly, by June 28, 2019, this Court once again directs Live Well Financial, Inc. to file a communication with this Court regarding the status of their representation. Live Well Financial, Inc. is once again cautioned that failure to comply with this Court's Order may result in a recommendation to the District Court that an order of default be entered. Plaintiff's counsel is directed to serve a copy of this order on Defendant Live Well Financial, Inc. and to file proof of service on the docket by June 21, 2019. So Ordered by Magistrate Judge Anne Y. Shields on 6/20/2019. (Mucciaccio, Dina) |

See Minute Order for details. So Ordered by Magistrate Judge Anne Y. Shields. (FTR Log #10:47-10:58.) (Torres, Jasmine) |
ELECTRONIC ORDER denying #34 Motion for Discovery; granting #46 Motion to Quash; granting #50 Motion to Stay; granting #58 Motion to Stay. For the reasons set forth on the record at the hearing held on April 16, 2019, Plaintiff's motion to serve pre-initial conference discovery is DENIED. Defendant Live-Well's motion to quash the two (2) subpoenas issued to non-parties and for a protective order barring Plaintiff from serving pre-initial conference discovery is GRANTED. Finally, Defendant Reverse Mortgage's motion to stay discovery as well as defendant Compu-Link's motion to stay discovery is GRANTED. The Court finds that the breadth and burden of the discovery sought as well as the risk of the unfair prejudice to the parties opposing the discovery outweigh any potential need for pre-initial conference discovery. The Court reminds Plaintiff that the discovery process, which occurs after a Court ordered initial conference, is the appropriate time and method for the gathering and exchanging of information. No discovery shall take place prior to an order from the District Court setting forth a discovery schedule. So Ordered by Magistrate Judge Anne Y. Shields on 4/16/2019. (Mucciaccio, Dina) |
