Pursuant to the patent venue statute, 28 U.S.C. 1400(b), "[a]ny civil action for patent infringement may be brought in the judicial district where the defendant resides, or where the defendant has committed acts of infringement and has a regular and established place of business." "[A] domestic corporation resides only in its State of incorporation for purposes of the patent venue statute." TC Heartland LLC v. Kraft Foods Group Brands LLC, 137 S.Ct. 1514, 1517 (2017). Defendant Snappyscreen, Inc. ("Snappyscreen") is incorporated in Delaware. Accordingly, it "resides" in Delaware and an action for patent infringement against Snappyscreen would be proper in Delaware. Snappyscreen, however, asks the Court to transfer Plaintiff's claims against it to the Eastern District of New York. According to the declaration submitted in support of its Motion to Sever and Transfer, Snappyscreen's principal place of business is in New York. But transfer to the Eastern District of New York is only proper if the Court finds that Snappyscreen has committed acts of infringement and has a regular and established place of business in that district. See 1400(b). The Complaint does not allege any acts of infringement outside the Southern District of Florida. The parties, therefore, are directed to submit supplemental briefing on whether the Eastern District of New York is an appropriate venue for Plaintiff's claims against Snappyscreen.
