July 2, 2019 Opinion or Order ORDER: The parties request an extension of time for defendant to respond to plaintiff's complaint. ECF No. #17 . Although the Court stated that it would not further extend defendant's time to respond, as both parties have consented, the request is granted. Defendant shall respond to plaintiff's complaint by August 6, 2019. The Court adjourns the July 17, 2019 initial conference in this case to August 13, 2019 in Courtroom 11A South of the United States Courthouse, 225 Cadman Plaza East, Brooklyn, New York. The parties shall exchange their Rule 26(a)(1) initial disclosures and file a 26(f) Meeting Report by August 6, 2019. Parties are advised that they must contact each other before making any request for an adjournment of the conference to the Court. Any request for an adjournment must be electronically filed with the Court at least forty-eight (48) hours before the scheduled conference. Ordered by Magistrate Judge Lois Bloom on 7/2/2019. June 20, 2019 Opinion or Order ORDER: Defendant requests an extension of time to respond to plaintiff's complaint. ECF No. 13. On June 19, 2019, plaintiff objected to defendant's request and stated that defendant must first vacate the certificate of default, ECF No. 12, before responding to plaintiff's complaint. ECF No. 15. On June 20, 2019, defendant replied to plaintiff's opposition noting that he had contacted plaintiff prior to plaintiff requesting a certificate of default and that plaintiff would not be prejudiced by this extension. ECF No. 16. Defendant's response to the summons and complaint herein was due on June 3, 2019. ECF No. 8. When defendant failed to respond, plaintiff requested and the Clerk of Court noted entry of defendant's default pursuant to Federal Rule of Civil Procedure 55(a) on June 11, 2019. ECF No. 12. Defendant's counsel filed a notice of appearance one week later on June 18, 2019.As defendant has appeared and the case is in its initial stages, the Court sua sponte vacates the certificate of default against defendant. See Pecarsky v. Galaxiworld.com Ltd., 249 F.3d 167, 172 (2d Cir. 2001) ("This Court has held that '[s]trong public policy favors resolving disputes on the merits[.]'") (citation omitted); Tr. of Empire State Carpenters Annuity, Apprenticeship, Labor-Mgmt. Coop., Pension and Welfare Funds v. Penco United, LLC, No. 13 CV 4745, 2015 WL 518623, at *7 (E.D.N.Y. Feb. 5, 2015) ("Because Rule 55(c) does not refer to a motion requirement, a court may set aside an entry of default sua sponte.") (internal quotation marks and citation omitted). Although the Court notes plaintiff's objection, defendant's request for an extension of time is granted. Defendant shall respond to plaintiff's complaint by July 8, 2019. The Court will not further extend defendant's time to respond.The Court shall hold the initial conference in this case on July 17, 2019 at 10:30 a.m. in Courtroom 11A South of the United States Courthouse, 225 Cadman Plaza East, Brooklyn, New York. The parties shall exchange their Rule 26(a)(1) initial disclosures and file a 26(f) Meeting Report by July 12, 2019.
