August 22, 2019 Opinion or Order Filing 8 MEMORANDUM AND ORDER: For the reasons set forth in the attached memorandum and order, Plaintiff's motion #5 for leave to proceed in forma pauperis is GRANTED for the purpose of this order, and the complaint is dismissed in its entirety because Defendant is immune from suit under the Eleventh Amendment. In light of his pro se status, Plaintiff is granted leave to file an amended complaint within 30 days from the entry of this memorandum and order. Cruz v. Gomez, 202 F.3d 593 (2d Cir. 2000). The amended complaint must be captioned "Amended Complaint" and bear the same docket number as this memorandum and order. Failure to file an amended complaint with 30 days, as directed by this memorandum and order, will result in dismissal of Plaintiffs case for failure to prosecute. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal. Coppedge v.
