ORDER: Plaintiff failed to serve his complaint and preliminary injunction motion on Defendants by the 10/7/2019 deadline previously set by the Court. (See 9/30/2019 Scheduling Order.) However, the Clerk of the Court did not mail the required summonses to Plaintiff until 10/7/2019. On October 4, 2019, Plaintiff left a voicemail on the Court's chambers line indicating that he plans on amending his complaint and preliminary injunction motion, and inquiring whether he needs to serve both his original and amended complaint and motion papers on Defendants. In light of these events, the Court sets the following new schedule: (1) Plaintiff shall serve Defendants the summonses sent by the Clerk's Office on 10/7/19, along with the original complaint and preliminary injunction moving papers, by 10/14/2019; (2) Defendants shall respond to Plaintiff's motion for preliminary injunction by 10/25/2019. The Court will hold the hearing on 10/29/2019, at 2:00 p.m. In response to Plaintiff's voicemail, the Court clarifies that if he decides to amend his complaint and motion, he will need to obtain new summonses for the amended complaint and re-serve Defendants. Plaintiff is advised that any future communication with the Court shall be in writing and filed with the Court. Lastly, in light of Plaintiff's #8 Notice re #4 Motion to Appoint Counsel, Plaintiff's #4 Motion to Appoint Counsel is deemed withdrawn. Ordered by Judge Pamela K. Chen on 10/8/2019. (Shi, Yi Qing) |
