ORDER granting in part #6 . First, this "status report" should have been designated as a motion on ECF, not a "status report", since it seeks relief from the Court. Second, plaintiff's counsel offers no reason why he has delayed service on a defendant that presents no service difficulties, and, obviously, plaintiff cannot recover in this case if his lawyer won't prosecute it. Counsel is advised that if service is not made within the time permitted by the Federal Rules, this action will be dismissed.
