Plaintiff's claims against Sheriff Flood and Henig are dismissed without prejudice pursuant to 28 U.S.C. 1915(e)(2)(B)(ii), 1915A(b)(1). Plaintiff is granted leave to file an amended complaint in accordance with this order. An amended complaint shall be clearly labeled "Amended Complaint", shall bear the same docket number as this Order, 20-CV-00141(GRB)(AKT), and shall be filed within 30 days from the date of this Order. If plaintiff does not file an amended complaint within the time allowed, judgment shall enter and this case will be marked closed. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal.
