August 25, 2020 Opinion or Order ORDER TO SHOW CAUSE. Plaintiff shall show cause by 9/2/2020 why this action should not be dismissed for lack of subject matter jurisdiction. See Bayerische Landesbank, New York Branch v. Aladdin Capital Management LLC, 692 F.3d 42, 49 (2d Cir. 2012) (citing Handelsman v. Bedford Village Associates Ltd. Partnership, 213 F.3d 48 (2d Cir. 2000)). First, plaintiff describes itself as "limited liability corporation," but there is no such thing, and the "LLC" following plaintiff's name obviously means that it is a limited liability company. Similarly, the complaint does not identify each of the members of defendant Winside Group LLC, nor their citizenship. It describes the individual defendants as "partners/owners" of Winside, but there are no "partners" or "owners" of an LLC, just members, and there is no allegation who the other members are of Winside, nor their citizenship, nor the citizenship of the individual defendants. Ordered by Judge Brian M. Cogan on 8/25/2020. (Weisberg, Peggy)
