September 25, 2020 Opinion or Order ORDER deferring ruling on #2 Motion for Judgment Based on Settlement: The Government filed a "Notice of Lodging" of a proposed Consent Judgment (hereafter, "Consent Judgment"). (See ECF No. #7 (hereafter, the "Notice").) Attached to the Notice was the same Consent Judgment that is filed herein as ECF No. #2 . Among other things, the Notice stated that: the Consent Judgment is subject to a 30-day public comment period after its publication in the Federal Register; and, after the close of the comment period, the Government will "determine whether any comments disclose facts or considerations that indicate that the proposed Consent Judgment is inappropriate, improper or inadequate, and will advise the Court whether [it] requests that the Consent Judgment be entered." (Id. at 1.) The Government did not indicate an anticipated publication date for the Consent Judgment. Rather, it stated "[n]o action is required by the Court at this time" and requested "that the Court not sign the proposed Consent Judgment unless and until the [Government] moves for entry of the Consent Judgment." (Id. at 1, 2 (emphases in original).) Accordingly, it is hereby ordered that, by no later than December 18, 2020, the Government file a Status Report with the Court regarding the status of the public comment period for said proposed Consent Judgment.
