NOTICE of Hearing: A security code has been added to the call in details for the 11/19/2020 initial telephone conference. Parties will use the toll-free number 888-684-8852, access code 6427877# and security code 4738#. (Weisberg, Peggy) |
Filing 13 Letter Joint Pursuant to 10-7-20 Scheduling Order by Board of Directors of the Academy Charter School, Wayne Haughton, Sandra O'Neil, The Academy Charter School (Attachments: #1 Exhibit Proposed Civil Case Management Plan for Initial Status Conference) (Guttell, Adam) |
ORDER re: #13 Joint Letter. Defendants' portion of this letter is of little use. The central issue in this case is obviously why defendants terminated plaintiff's employment, and the only reference to that is a general statement that there was a legitimate nondiscriminatory reason. Defendants' statement that they need discovery to determine this makes no sense since defendants ought to know why they terminated plaintiff. They have thus given the Court no assistance in understanding or evaluating the parties' positions in this case. If defendants expect to play this case close to the vest, this is a civil case and that is not going to occur. Defendants are directed to file a supplemental letter prior to the conference fully setting forth the alleged legitimate nondiscriminatory reason and the circumstances surrounding it or the Court will make an appropriate order at the conference under Federal Rule of Civil Procedure 16(f). Ordered by Judge Brian M. Cogan on 11/13/2020. (Weisberg, Peggy) |
Filing 12 Letter MOTION to Adjourn Conference by Board of Directors of the Academy Charter School, Wayne Haughton, Sandra O'Neil, The Academy Charter School. (Guttell, Adam) |
ORDER denying #12 . The Court does not wait for an answer to hold the initial status conference because the answer rarely supplies any useful information. What is useful is the joint summary letter that the parties must present before the conference. There is plenty of time before the conference for defense counsel to ascertain their clients' side of the story to contribute to that letter. The conference scheduled for 11/19/2020 at 12:45 pm will be held by telephone. Parties are directed to use the toll-free number 888-684-8852 and access code 6427877#. They are reminded to comply with the mandatory requirements set forth at #6 and shall file on the docket a completed case management plan prior to the conference. Ordered by Judge Brian M. Cogan on 10/23/2020. (Weisberg, Peggy) |
