The Court is in receipt of Plaintiff's request for a pre-motion conference (Docket Entries 8 and 10) regarding Defendants' alleged failure to comply with the Order to Show Cause with Temporary and Preliminary Restrictions entered by Honorable Elizabeth Hazlitt Emerson on October 14, 2020 (the "State Court Order"). Defendants oppose the request. (D.E. 9.) Upon review of the submissions, it is hereby ORDERED that on or before December 8, 2020, Defendants shall file a letter brief, not to exceed seven (7) pages, addressing (1) the status of proceedings before Honorable Elizabeth Hazlitt Emerson prior to removal to this Court (D.E. 1); (2) why this Court should retain jurisdiction and resolve the parties dispute over compliance with the State Court Order; and, if so, (3) whether, in the interest of comity, the Court should remand this action back to the state court for adjudication. Plaintiff shall file an opposition brief, not to exceed seven (7) pages, on or before December 15, 2020. No reply letter brief is permitted. If necessary, the Court will schedule a hearing date.
