ORDER further deferring ruling on #15 . The Court is disinclined to permit withdrawal based on circumstances that counsel knew or should have known when they accepted the clients' retainer and that do not warrant disqualification under the Rules of Professional Conduct. This is merely a business issue for counsel that has nothing to do with defendants. However, if defendants voluntarily consent to retain new counsel by 2/15/2021, with substitute counsel representing that they have conferred with defendants and that defendants understand their right to proceed with current counsel and have decided nonetheless to appear by new counsel, the Court will grant the motion. Otherwise, it will be denied and the case will proceed with current counsel. The Court finds that because the affidavit that counsel has filed ex parte #16 contains business information of defendants' counsel, its interest in privacy outweighs the public's qualified right of access to the Court's docket.
