ORDER granting #2 Motion for Leave to Appeal in forma pauperis. Upon review of the in forma pauperis application, the Court finds that plaintiff's financial status qualifies plaintiff to commence this action without prepayment of the filing fee. See 28 U.S.C. 1915(a)(1). Accordingly, plaintiff's application to proceed in forma pauperis is granted. Counsel for plaintiff is directed to serve the complaint on defendant. Defendant shall serve the administrative record on plaintiff by July 22, 2021, but shall not file the record on ECF until the motion is fully briefed. Plaintiff shall serve a motion for judgment on the pleadings, by September 22, 2021; Defendant shall serve a response to Plaintiff's motion, and any cross-motion, by November 19, 2021; and Plaintiff shall serve a reply and file the fully briefed motion, including the administrative transcript, on ECF, by December 10, 2021.
