SHOW CAUSE ORDER. Whereas examination of the complaint herein reveals that this case does not appear to seek damages above the jurisdictional minimum, plaintiff shall SHOW CAUSE why the complaint should not be dismissed. Tagger v. Strauss Grp. Ltd., 951 F.3d 124, 126 (2d Cir. 2020) (Under 28 U.S.C. 1332, federal courts have jurisdiction to hear cases between diverse parties where the matter in controversy exceeds the sum or value of $75,000). ORDER TO SHOW CAUSE: In its response to this Court's earlier Order of August 31, 2021, plaintiff is additionally directed to explain its basis for alleging complete diversity of citizenship in this case under 28 U.S.C. 1332, given that (a) plaintiff fails to set forth its own citizenship and (b) the defendants in this action are identified as, simultaneously, "domestic limited liability companies authorized to conduct business" in New York, "domestic corporations formed pursuant [to] the laws of the Stat[e] of [N]ew York," and "foreign Corporations formed pursuant to the laws of a S[t]ate other than New York," all of which are mutually exclusive categorizations. To the extent that the defendants are alleged to be limited liability companies, plaintiff is directed to set forth, to the extent it is able, the membership of each of the defendant LLCs, as limited liability companies take the citizenship of each of their members.
