ORDER granting #4 Motion for Order to Show Cause: In accord with the referral of this matter, and in view of the fact that Plaintiff requests only a briefing schedule and not a temporary restraining order, the Court sets the following briefing schedule: (1) The United States Attorney, as attorney for Defendants, is directed to show cause on or before February 21, 2022, in writing, why a writ of mandamus should not be issued, and shall serve a copy of the response to Plaintiffs, with proof of such service to the Clerk of the Court; (2) On or before March 21, 2022, Plaintiffs shall file a reply, if any, with proof of service to the Clerk of the Court. This Court declines to set a date for oral argument of the matter before the District Judge. If the District Judge finds that oral argument is necessary, she will schedule a hearing at her own convenience. All motion papers shall be filed to the District Judge assigned to this action, in accordance with her Individual Rules. Plaintiff's counsel is directed to serve a copy of this Order on Defendants' counsel, and to file proof of service on the docket sheet, by December 23, 2021. So Ordered by Magistrate Judge Anne Y.
