February 24, 2022 Opinion or Order ORDER re: #8 . Plaintiff's description of the case is wholly inadequate and must be supplemented prior to the conference. Of course the Court knows that plaintiff thinks defendant was negligent. In this letter, plaintiff has to explain what the defendant did or didn't do that constitutes negligence. Boilerplate allegations are not sufficient, and even having them standing alone in the complaint raises an issue under Rule 11. As part of explaining the misconduct by defendant, plaintiff is going to have to describe how this accident happened. If plaintiff fails to file a supplemental letter that actually says something prior to the conference, the Court will impose sanctions under Rule 16(f). Ordered by Judge Brian M. Cogan on 2/24/2022.
