ORDER granting #2 Motion for Leave to Proceed in forma pauperis - Plaintiff is granted leave to file this action without prepayment of the filing fee. However, because plaintiff fails to state a claim upon which relief can be granted, the complaint is dismissed pursuant to 28 U.S.C. 1915(e)(2)(B) and 1915A(b) and leave to replead is denied. A certificate of appealability shall not issue because plaintiff has not made a substantial showing that he was denied any constitutional rights. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal of this order would not be taken in good faith and therefore in forma pauperis status is denied for any appeal on those grounds.
