February 22, 2022 Opinion or Order ORDER TO SHOW CAUSE: Following review of the complaint herein, and in light of the Supreme Court's decision in TC Heartland LLC v. Kraft Foods Grp. Brands LLC, 137 S.Ct. 1514, 1519 (2017) (holding in patent infringement actions, venue is exclusively governed by 28 U.S.C. 1400(b)), plaintiff's counsel is to file a letter by close of business on February 21, 2022 stating with specificity counsel's basis for venue. Additionally, on the cover sheet, counsel for plaintiff responded affirmatively to the following questions: a. "Did the events or omissions giving rise to the claim or claims, or a substantial part thereof, occur in Nassau or Suffolk County? And b. "Did the events or omissions giving rise to the claim or claims, or a substantial part thereof, occur in the Eastern District?" For each of these questions, provide a detailed factual explanation as to the basis for those responses. Counsel shall answer these questions or indicate whether they consent to a transfer.
