ORDER granting in part and denying in part #6 Motion for Pre Motion Conference: On April 29, 2022, the Defendants requested a pre-motion conference ("PMC Motion") seeking to file a motion to dismiss Plaintiff's Complaint, which asks this Court "to issue an 'Order' ensuring that an appropriate 'age-variance application' is submitted to the State for review." (Compl., ECF No. 1, at 12 ("WHEREFORE" clause).) To date, Plaintiff has not responded to the PMC Motion, and his time to do so has expired. (Cf. Case Docket, in toto, with JS Ind. Rule III(B)(1) ("The opposing party shall have seven (7) days to submit a letter response.").) Having considered the PMC Motion, the Court has determined a pre-motion conference is not necessary and waives that requirement. However, the PMC Motion is GRANTED to the extent Defendants may move to dismiss this action. Accordingly:(1) by no later than July 8, 2022, Defendants are to serve and file their Dismissal Motion;(2) by no later than August 5, 2022, Plaintiff is to serve and file his response; and,(3) by no later than August 26, 2022, Defendants are to serve and file their reply, if any.Once the Dismissal Motion is fully briefed, the parties are to ensure courtesy copies of their submissions are promptly provided to Chambers.
