ORDER DISMISSING CASE: Upon examination of the complaint in this matter, which is premised entirely on diversity jurisdiction, it appears that plaintiff seeks a total of approximately $40,000 in actual damages. This sum is far below the jurisdictional minimum. Of course, the complaint also seeks $55 million in punitive damages. Careful consideration of this matter reveals that upon the facts alleged, there is no set of circumstances under which this Court would award such a sum or any sum that would even near the jurisdictional minimum. To avoid unneeded delay and unnecessary litigation costs the matter is dismissed without prejudice. The Clerk of the Court is respectfully directed to close the case. Ordered by Judge Gary R.
