Pursuant to the Federal Arbitration Act ("FAA") 9 U.S.C. 1, et seq., this action is stayed pending arbitration; 2. Plaintiff shall commence arbitration within sixty (60) days of : (a) the parties' agreement regarding an arbitrator, in which case the arbitration shall be before that arbitrator, or (b) either party declaring an impasse as to agreement regarding the arbitrator, in which case the arbitration shall be before the American Arbitration Association; 3. Defendants shall bear all fees and costs unique to arbitration, including the Arbitrator's fee, except that Plaintiff shall bear the cost of the filing fee; 4. Plaintiff shall not pursue his Fifth Cause of Action for alleged retaliation under the New York State Human Rights Law in Arbitration or any other forum, and such Cause is dismissed from this action with prejudice because the claim is time-barred.
