ORDER denying #5 Motion for Reconsideration re #5 Letter MOTION for Reconsideration and enclosing proof of service re summons and complaint filed by Kristin Guldi. While the Court remains sympathetic to the plaintiff's plight, this letter fails to meet the demanding standard for the relief sought. See In re Health Mgmt. Sys. Inc. Sec. ORDER DISMISSING CASE: Plaintiff pro se Kristin Guldi, as Executrix for the Estate of Gregory Jo Guldi, brings this action against defendants Federal National Mortgage Association, Vincent F. DeMarco also known as Vincent F. Demarco, James N. Faller, Patricia Byrne Blair and Barbara Wilson in an effort to challenge a pending eviction through, inter alia, the issuance of a Temporary Restraining Order ("TRO") as against the execution of a 72-hour Warrant of Eviction. Of course, because plaintiff is proceeding pro se, this Court accords her claims the solicitude afforded to pro se litigants. See Tracy v. Freshwater, 623 F.3d 90, 101 (2d Cir. 2010) ("It is well established that a court is ordinarily obligated to afford a special solicitude to pro se litigants... [which] most often consists of liberal construction of pleadings, motion papers, and appellate briefs."). While the complaint cites a broad array of legal theories, it is devoid of any cognizable facts upon which this Court could grant relief. See Docket Entry No. 1. Moreover, because the complaint seems to be an effort by an unsuccessful state court litigant to relitigate matters before this Court, under the Rooker-Feldman doctrine, the Court would be required to abstain from the exercise of jurisdiction. See Vossbrinck v. Accredited Home Lenders, Inc., 773 F.3d 423, 425 (2d Cir. 2014) (under the Rooker-Feldman doctrine federal court lacks jurisdiction where plaintiff challenges state foreclosure judgment). Based on these considerations, the application for a TRO is DENIED, and the Complaint is dismissed without prejudice.
