July 27, 2022 Opinion or Order SCHEDULING ORDER: re #17 Order on Motion for Order to Show Cause: Due to unforeseen circumstances, the Court is unavailable on Friday, July 29, 2022, and will not be available until Wednesday, August 3, 2022 at 9:00 a.m. (Courtroom No. 1030) to conduct the Show Cause Hearing on Plaintiff's Motion for a Preliminary Injunction. (See OSC Order, ECF No. #17 .) The August 3rd date is after the expiration of the Court's Temporary Restraining Order ("TRO"). (See id. at 2, 3.) See also Fed. R. Civ. P. 65(b)(2). However, before it expires, a temporary restraining order may be extended for good cause and for a period not to exceed 14 days. See Fed. R. Civ. P. 65(b)(2). "Courts have found the unavailability of the trial judge as good cause for extending a TRO." Cortland Line Hldgs. LLC v. Lieverst, No. 5:18-CV-0307, 2018 WL 10758585, at * 2 (N.D.N.Y. Mar. 23, 2018) (citation omitted). Thus, because of the its unavailability, the Court finds good cause to extend its July 15, 2022 TRO.
