April 14, 2022 Opinion or Order Filing 30 PAPERLESS ORDER granting #29 Plaintiff's Motion to Amend His Complaint ("Motion"). The Court notes that Plaintiff has failed to include in his Motion a certificate of conferral with opposing counsel as required by the Local Rules. But having considered Plaintiff's pro se status and after carefully reviewing the Motion, the Court finds that giving Plaintiff the opportunity to amend his #1 Complaint is warranted given that the amendment appears to be in the interest of justice and does not appear to be frivolous in nature. See Fed. R. Civ. P. 15(a) ("The Court should freely give leave [to amend] when justice so requires."); Garfield v. NDC Health Corp., 466 F.3d 1255, 1270 (11th Cir. 2006) ("In the absence of any apparent or declared reason--such as undue delay, bad faith or dilatory motive on the part of the movant, repeated failure to cure deficiencies by amendments previously allowed, undue prejudice to the opposing party by virtue of allowance of the amendment, futility of amendment, etc.--the leave sought should, as the rules require, be freely given.") (quoting Foman v. Davis, 371 U.S. 178, 83 (1962)) (internal quotation marks omitted).Going forward, Plaintiff is reminded that he shall comply with all Federal Rules of Civil Procedure and Local Rules for the Southern District of Florida. The Local Rules may be obtained from the Clerk of the Court. Failure to comply with the Rules may result in sanctions being imposed against pro se litigants. Among the Local Rules is a requirement that, subject to enumerated exceptions, each party, "[p]rior to filing any motion in a civil case... shall confer (orally or in writing), or make reasonable effort to confer (orally or in writing), with all parties or non-parties who may be affected by the relief sought in the motion in a good faith effort to resolve by agreement the issues to be raised in the motion." April 8, 2022 Opinion or Order Filing 28 PAPERLESS ORDER granting #27 Defendants' Motion to Abate Discovery and Case Management Deadlines Pending Resolution of the Defendants' Motion to Dismiss, Motion for Protective Order, and Incorporated Memorandum of Law ("Motion"). District courts enjoy broad discretion in deciding how to best manage the cases before them. See Johnson v. Bd. of Regents of Univ. of Ga., 263 F.3d 1234, 1269 (11th Cir. 2001); Chrysler Int'l Corp. v. Chemaly, 280 F.3d 1358, 1360 (11th Cir. 2002). And a stay of discovery is appropriate where the movant shows good cause and reasonableness. Varga v. Palm Beach Cap. Mgmt., LLC, No. 09-82398, 2010 WL 8510622, at *1 (S.D. Fla. Sept. 3, 2010) (cleaned up); see also Point Conversions, LLC v. Lopane, No. 20-61549, 2020 WL 6700236, at *1 (S.D. Fla. Oct. 29, 2020) (staying discovery pending a decision on defendant's motion to dismiss which raises serious questions regarding the viability of Plaintiff's Complaint that must be resolved before Defendant is burdened with discovery and other pretrial obligations). Further, where a pending motion may dispose of the entire action, granting a stay of discovery not necessary for resolution of the motion may be justified. See Chudasama v. Mazda Motor Corp., 123 F. 3d 1353, 1367 (11th Cir. 1997) ("Facial challenges to the legal sufficiency of a claim or defense, such as a motion to dismiss based on failure to state a claim for relief, should... be resolved before discovery begins."). Here, upon preliminary review of #19 Defendants' Motion to Dismiss, the Court finds that there is a possibility said Motion could lead to the disposition of this action, so a stay is justified.
