October 3, 2022 Opinion or Order ORDER granting #10 Motion for Leave to Allow Pro Se to Electronically File. Before the Court is Plaintiff's renewed motion for ECF filing privileges (ECF No. #10 ). In its discretion and pursuant to Rule 5(d)(3)(B) of the Federal Rules of Civil Procedure, the Court GRANTS Plaintiff's Motion for Leave to Allow Pro Se to Electronically File, with the expectation that Plaintiff will judiciously exercise the privilege of electronic filing, and subject to revocation if the Court determines this privilege is being abused or revocation is otherwise warranted. Plaintiff shall register for ECF; registration is available online at www.pacer.gov. PLAINTIFF IS ON NOTICE: Thereafter, any paper filing by Plaintiff will not be accepted for filing and will be returned. Further, insofar as Plaintiff seeks a fee waiver for the use of PACER and CM/ECF, that request is DENIED at this time. As a party to this case, Plaintiff receives a Notice of Docket Activity each time a new docket entry is made with one free look at that entry. Plaintiff may print or save that document without incurring any fees. In addition, any PACER fees are automatically waived when a party's costs are $30 or less in a quarter and Court opinions are always free. September 19, 2022 Opinion or Order ORDER: By Order dated September 6, 2022 (ECF No. #5 ), the Court denied Plaintiff's original application to proceed in forma pauperis ("IFP") and ordered him to pay the filing fee within fourteen days. Now before the Court are Plaintiff's renewed applications to proceed IFP and for electronic filing privileges, both filed on September 8, 2022 (ECF Nos. #6 #7 ), as well as Plaintiff's Supplemental Motion for Leave to Proceed IFP (ECF No. #9 ). The Court liberally construes Plaintiff's subsequent applications to proceed IFP as seeking reconsideration of the September 6, 2022 Order. In light of the additional information provided to the Court in these submissions, the Court finds that Plaintiff is qualified to proceed IFP. Accordingly, the Court GRANTS his motions (ECF Nos. #6 #9 ) and ORDERS that the Clerk of the Court issue a summons to the Defendant and forward the summons together with copies of the complaint, the amended complaint, and this Order to the United States Marshal for service upon the Defendant forthwith. Plaintiff's application seeking electronic filing privileges is DENIED WITHOUT PREJUDICE and with leave to renew. As the Court made clear in its September 6, 2022 Order, any application seeking electronic filing privileges shall "indicate the reason such privileges are required. If granted, the Court will no longer accept or send hard copies from or to Plaintiff. Any renewed application for ECF filing privileges shall makeclear Plaintiff's understanding and acceptance of this responsibility." (ECF No. #5 at 1 n.1.)
