November 2, 2022 Opinion or Order Filing 7 MEMORANDUM & ORDER granting #5 Motion for Leave to Proceed in forma pauperis: Based on the foregoing, Plaintiffs application to proceed IFP (DE 5) is granted. However, the complaint is dismissed pursuant to 28 U.S.C. 1915(e)(2)(B)(i)-(ii) and 1915A(b)(1). Plaintiff may pursue any valid claims he may have, including negligence, in state court. The Clerk of the Court shall enter judgment accordingly and mark this case closed. The Clerk of the Court shall also mail a copy of this Order to the pro se Plaintiff at his address of record and note service on the docket. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). So Ordered by Judge Gary R. Brown on 11/2/2022. (JC) CM to pro se plaintiff.
