SCHEDULING ORDER: On November 18, 2022, defendant filed a letter requesting a pre-motion conference concerning a proposed motion to dismiss. My individual rules require parties to respond to pre-motion conference letters within seven days. Plaintiffs failed to respond within that time and, on November 29, 2022, were warned that, if they "still intend to prosecute the lawsuit, they must, by December 2, 2022, either (1) file their opposition to defendant's pre-motion conference letter, or (2) indicate by letter to the Court that they do not wish to file an opposition but still intend to prosecute this lawsuit." Plaintiffs were further warned that their failure to respond to the November 29, 2022 Order "may result in the dismissal of this action pursuant to Federal Rule of Civil Procedure 41(b)." To date, Plaintiffs have failed to respond to the Court's November 29, 2022 Order, but are directed to do so by or before December 12, 2022. Failure to do so may result in the dismissal of this action pursuant to Federal Rule of Civil Procedure 41(b). Ordered by Judge Joan M. Azrack on 12/7/2022. (MB) |
