ORDER: Defendant has removed this case from the District Court of the State of New York, Suffolk County, based on Defendant's assertion that federal question jurisdiction exists over Plaintiff's complaint, which asserts a single cause of action for a violation of the Fair Credit Reporting Act, specifically 15 U.S.C. 1681i. Defendant shall file on or before January 18, 2023, a letter not exceeding three pages explaining why Plaintiff's complaint satisfies the "concrete harm" requirement necessary to establish Article III standing, as described by the U.S. Supreme Court in TransUnion LLC v. Ramirez, 141 S. Ct. 2190 (2021), and the U.S. Court of Appeals for the Second Circuit in Maddox v. Bank of N.Y. Mellon Tr. Co., N.A., 19 F.4th 58 (2d Cir. 2021). Plaintiff shall file a responsive letter not exceeding three pages on or before January 25, 2023, explaining Plaintiff's position regarding whether this case was properly removed to this Court.
