July 27, 2023 Opinion or Order ORDER: Plaintiffs who commenced this lawsuit are the defendants in a previously-filed lawsuit pending before the Court (No. 21-cv-759), involving exactly the same parties that also arises from the same business that the parties previously operated together. In that case, the Court denied the defendants' motion to amend their answer to assert new counterclaims, after hearing argument on the motion on May 18, 2023. Now, however, those same defendants, acting as Plaintiffs in this case, appear to be asserting essentially the same claims in their complaint. Plaintiffs shall file a letter no longer than five pages on or before August 3, 2023, explaining why this case should not be dismissed as duplicative of the parties' related case since the Second Circuit has explained that a party "who is unhappy with a district court's denial of" a motion to amend a pleading does not have "an unfettered right to bring a new action against that very defendant, effectively neutralizing the district court's ruling on the motion to amend." Wang v. Ren, No. 20-4216-cv, 2023 WL 1977233, at *2 (2d Cir. Feb. 14, 2023) (affirming dismissal of second-filed lawsuit as duplicative). Defendants shall file a responsive letter no longer than five pages on or before August 8, 2023.The Court will likely take under consideration whether to dismiss this case as duplicative of the parties' previously-filed case based solely on the parties' letters, without affording the parties an opportunity further to brief the issue, regardless of whether Plaintiffs and Defendants each file their respective letters required by this order.Plaintiffs' counsel shall inform the attorneys representing Defendants in the parties' previously-filed case of the commencement of this case and this order, in writing, no later than July 28, 2023, and Plaintiffs shall file a letter on this docket no later than July 31, 2023, confirming that they have done so.
