Filing 11 Mail Returned as Undeliverable. Mail sent to Copy of Documents 7 Summons Issued with Instruction on how to serve. Mailed to Martin Nowak at 113 New York Long Beach, NY 11561. (GA) . MAIL RETURNED AS REFUSED. (RG) (Entered: 08/29/2023) |
Filing 10 ORDER TO SHOW CAUSE: For the reasons set forth above, plaintiff is directed to Show Cause in writing within 20 days from the date of this Order why the Court should not dismiss this action for lack of subject matter jurisdiction pursuant to Fed. R. Civ. P. 12(h)(3). This Order to Show Cause does not supersede the prior Order of Judge Bulsara which directed plaintiff to file proper proof of service on defendant no later than October 9, 2023, unless this Court dismisses the case prior to that date. Although plaintiff has paid the filing fee to initiate this action, the Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Clerk of Court is respectfully directed to mail a copy of this Order to Show Cause to plaintiff and to note the mailing on the docket. Ordered by Judge Brian M. Cogan on 8/9/2023. (IH) |
Filing 9 NOTICE of incorrect order for Transfer by CONTINENTALIS DIVITIAE EXPRESS TRUST: By: Co-Trustee, Nowak, Martin. (IH) |
Filing 8 ORDER: The Courts records reflect that the Complaint in this action was filed on July 10, 2023. Accordingly, if proper service of the Complaint and Summons is not made upon Defendant by October 09, 2023, or if Plaintiff fails to show good cause as to why such service has not been made, I will recommend that the District Judge dismiss this action without prejudice. After Defendant has been served, Plaintiff must file with the Court proof of service of the Complaint and Summons. Fed. R. Civ. P. 4(l)(1). The service and filing of papers other than the Summons and the original Complaint is governed by Federal Rule of Civil Procedure 5, as well as by the applicable Individual Rules. Although pro se Parties are automatically exempt from mandatory electronic filing, they are not exempt from the service and filing requirements of Rule 5. Plaintiff is required to advise the Clerk of Court of any change of address. Failure to keep the Court informed of Plaintiff's current address means the Court will not know where to contact Plaintiff and may result in dismissal of the case. For information regarding court procedures, Plaintiff may contact the Pro Se Office at the United States Courthouse by calling (718) 613-2665 or visit the Court's website at https://nyed.uscourts.gov/self-representation. So Ordered by Magistrate Judge Sanket J. Bulsara on 8/8/2023. (EM) |
