September 26, 2023 Filing 11 Minute Order for proceedings held before Magistrate Judge James M. Wicks: CIVIL CAUSE FOR INITIAL CONFERENCE. Counsel for Plaintiff: Jonathan Burke Van Dina. Counsel for Defendant: Patricia A. O'Connor. Initial Conference Hearing held on 9/26/2023 at 10:30 AM. Discussion was held regarding the parties' request to hold expert discovery in abeyance. Following discussion with counsel and review of the submitted worksheet, that request is denied with leave to renew after dispositive motion practice is initiated for the reasons stated on the record, and the Court adopts Scheduling Order which is attached at ECF No. #12 . The parties' requested that the case caption reflect the correct defendant as Wal-Mart Stores East, LP. The parties are directed to file a stipulation to amend the caption on or before October 6, 2023. To the extent the parties are interested in a settlement conference before the Court, they may reach out to chambers at any point to schedule a date. A Status Conference has been scheduled for December 4, 2023 at 11:30 AM via the Court's Video Zoom. The Court will email the Zoom invitation closer to the conference date. This conference is a public proceeding, and all are welcome to attend via telephone or via video.
