SCHEDULING ORDER: Pending before the Court is plaintiff's motion for a preliminary injunction restraining approximately $510,000 pending resolution of this action. In its various filings, plaintiff has described an alleged Ponzi investment scheme carried out by defendant Garfinkel and his various related entities and by which he has been defrauded of the subject funds. In response, Garfinkel has suggested that plaintiff transferred the subject funds to Garfinkel's entities as a loan, without the parties ever agreeing on the repayment terms, accrued interest or any other provisions. Other sworn statements by Garfinkel raise concerns, including his statement that he has never been involved in litigation in New York, though public filings reveal that one defendant, "5G Funding LLC," of which Garfinkel is a member (and perhaps the sole member) has frequently been a plaintiff in New York State courts. Similarly, 5G has been represented in this Court as a Florida entity, while it has been portrayed in at least one state court filing as a Delaware entity. Thus, the parties and their attorneys are hereby directed to appear before the Court in person on Tuesday, September 26 at 2pm for an evidentiary hearing concerning the pending motion for a preliminary injunction. Counsel should be prepared to offer testimony and all relevant evidentiary submission concerning the above-identified issues as well as any other matters which they believe bear on the potential issuance of a preliminary injunction. FAILURE TO APPEAR AS DIRECTED MAY RESULT IN EITHER ENTRY OF THE REQUESTED RELIEF WITHOUT FURTHER PROCEEDINGS OR DISMISSAL OF THE ACTION, AS APPROPRIATE. Ordered by Judge Gary R. Brown on 9/21/2023. ORDER denying #8 Motion for Leave to Appear Pro Hac Vice: Local Civil Rule 1.3(c) requires a certificate of good standing "for each of the states in which the applicant is a member of the bar." The within application only contains a certificate of good standing from a federal district court in which the movant is admitted, which is insufficient for pro hac vice admission.
