November 3, 2023 Opinion or Order ORDER TO SHOW CAUSE. Plaintiff commenced this putative class action in federal court by invoking diversity subject-matter jurisdiction under the Class Action Fairness Act of 2005 ("CAFA"), 28 U.S.C. 1332(d)(2)(A). Upon review of the complaint, the Court sua sponte orders the parties to show cause why the Court should not abstain and dismiss this case without prejudice pursuant to one or more of the following exceptions to CAFA jurisdiction: (a) the "local controversy" mandatory abstention exception, id. 1332(d)(4)(A); (b) the "home-state controversy" mandatory abstention exception, id. 1332(d)(4)(B); or (c) the "discretionary" abstention exception, id. 1332(d)(3). The parties shall each respond to this Order, in writing, by 11/17/2023. If the parties agree that any of the above-listed CAFA exceptions apply, the parties may, in lieu of any substantive response, simply file an agreed-upon stipulation of dismissal without prejudice for the Court's review. If the parties believe that discovery will be necessary to respond to this Order, they may submit a letter to the Court requesting a telephone conference. Ordered by Judge Joan M.
