ORDER re #6 . On 9/22/2023, Plaintiffs filed a Motion for Protective Order to Proceed Under Pseudonym and an accompanying Proposed Order (See DE #6 ). As written, the discussion and analysis of the applicable law in Plaintiffs' Proposed Order is deficient. Plaintiffs are directed, in a re-drafted Proposed Order, to analyze the test governing the exception to the presumption of disclosure set forth in Sealed Plaintiff v. Sealed Defendant, 537 F.3d 185 (2d Cir. 2008). The Second Circuit in Sealed Plaintiff set forth a balancing test under which courts should weigh "the plaintiff's interest in anonymity" against "both the public interest in disclosure and any prejudice to the defendant" and noted with approval ten "non-exhaustive" factors that courts could consider when assessing a party's request to proceed with a pseudonym. Plaintiffs are directed to re-submit a Proposed Order weighing the applicable factors identified in Sealed Plaintiff no later than 10/27/2023. Ordered by Judge Joan M. Azrack on 10/16/2023. (JSB)
