December 15, 2023 Opinion or Order ELECTRONIC SCHEDULING ORDER: On 10/6/2023 Plaintiff Kashon Squire ("Plaintif") filed a pro se complaint in this Court while incarcerated at the Fishkill Correctional Facility together with an incomplete application to proceed in forma pauperis ("IFP") and Prisoner Litigation Authorization form ("PLA"). See DEs #1 , #2 . Accordingly, by Notice of Deficiency dated 10/13/2023 Plaintiff was instructed to complete and return the enclosed IFP application and PLA within fourteen (14) days in order to proceed with this case. See DE #3 . The Notice was mailed to Plaintiff at his address of record and has not been returned to the Court as undeliverable. To date, Plaintiff has not paid the fee, has not filed a complete IFP application and PLA, and has not otherwise communicated with the Court about this case. In an abundance of caution and in light of Plaintiff's pro se status, he is afforded one final opportunity to either pay the filing fee or to complete and return the IFP application and PLA by 12/29/2023. Plaintiff is on notice that the complaint will be dismissed without prejudice pursuant to Federal Rule of Civil Procedure 41(b) for failure to prosecute if he fails to timely comply with this Order. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962).The Clerk of the Court is respectfully directed to mail a copy of this order and DE #3 to Plaintiff at his address of record in an envelope marked "LEGAL MAIL."
