ORDER withdrawing #4 Motion to Dismiss for Failure to State a Claim; withdrawing #5 Motion to Dismiss for Failure to State a Claim. The Court shall construe defendants' letters, DE 4 and 5, as requests for leave to file a two-page letter seeking a pre-motion conference in anticipation of filing a fully-briefed motion to dismiss. Such a request is GRANTED. Consistent with Judge Locke's Electronic Order dated December 21, 2023, counsel for defendants is directed to review the Court's Individual Rules concerning such pre-motion letters, specifically Rule II(g), which, in sum, requires that counsel outline their anticipated motion in the letter and cautions that arguments not raised in the pre-motion letters or during the pre-motion conference shall be deemed waived. Finally, as stated in Rule II(g)(2), "[f]or purposes of time requirements for the filing of answers and motions under FRCP 12(a)... a pre-motion conference letter will be considered the equivalent of the motion itself."
