March 6, 2024 Opinion or Order ORDER granting #26 Motion to Amend/Correct/Supplement. In this action, plaintiff moved for preliminary injunctive relief seizing certain bank accounts. The Court rejected an application to determine these matters on an ex parte basis. Electronic Order dated 2/16/24. The Court then held an adversarial hearing on notice (contrary to defendants' improper suggestion that "The Court already [...] allowed plaintiff to present arguments and evidence with no prior notice to defendants.") DE 29 at 1. At that hearing, the Court made specific findings that plaintiff had provided a sufficient showing warranting the issuance of a TRO as to defendant Maddali, but not as to defendant Copper Bricks LLC. DE 22. Notwithstanding this Court's direction that counsel meet and confer to resolve additional issues that might arise, it appears that accounts in the name of Copper Bricks have been improperly frozen pursuant to the Court's order, and defendants seek a modification of the Order. DE 22, 26. In response, plaintiff's counsel has the temerity to suggest that the Court should extend the improper freeze of Copper Bricks' accounts on the basis of purported evidence not yet submitted to the Court, and that counsel has, on his own initiative failed to "instruct[] the institutions to release all accounts not titled to Mr. Maddali as set forth in the Order." DE 28. Counsel's argument is frivolous, and his actions appear highly irresponsible. Counsel is hereby cautioned that continued gamesmanship in such matters could result in sanctions including but not limited to the dissolution of the injunction. R. Civ. P., Fidelity Investments shall forthwith upon being served with a copy of this Order restrain all funds in and hereafter deposited into all Fidelity Investments accounts titled to Hari Maddali, except that the first $3,000.00 between all such accounts will be exempt from restraint and trading will still be permitted as long as no funds are withdrawn from the accounts; and it is further ORDERED that within seven days after being served with a copy of this Order, Fidelity Investments shall send Plaintiff's attorneys a report listing each account restrained pursuant to this Order, the name of each holder of each such account, and the amount restrained in each such account; and it is further ORDERED - SEE ATTACHED ORDER FOR FURTHER DETAILS. It is further ordered that following good faith efforts between counsel between counsel to resolve any further issues, counsel may make further application for modifications of this order.
