ORDER denying #7 Motion for Pre Motion Conference. I have reviewed the parties' letters regarding the requested pre-motion conference and have determined that a conference is not necessary. Plaintiff's response appears to concede that the complaint is deficient in some respects and proposes certain amendments to address the defects. Rather than grant defendant leave to file a motion to dismiss a complaint that plaintiff has proposed amending, I will grant plaintiff leave to amend the complaint. Plaintiff is directed to file an amended complaint on or before March 22, 2024. If defendant still wishes to file a motion to dismiss after reviewing the amended complaint, defendant should file a second motion for a pre-motion conference. Ordered by Judge Allyne R. Ross on 3/13/2024. (MK) |
