Filing 8 ORDER. On February 28, 2024, Marc Anthony Mascuzzio ("Plaintiff") filed a complaint in this Court but did not pay the filing fee or file an application to proceed in forma pauperis ("IFP") with the required Prisoner Litigation Authorization form ("PLA"). Accordingly, by Notice of Deficiency dated March 5, 2024, Plaintiff was instructed to, within 14 days, either pay the fee or file an IFP application and PLA. (ECF No. 2.) To date, Plaintiff has not responded to the Notice and the Notice has not been returned to the Court as undeliverable. Plaintiff is now ORDERED to, within 14 days, either: (1) complete and file the enclosed IFP application and PLA included with this Order; or (2) pay the $405 filing fee. Plaintiff is warned that his failure to timely comply absent a showing of good cause will lead to the assignment of a district judge to this case and a recommendation to the district judge that the complaint be dismissed without prejudice for failure to prosecute. The Clerk of the Court is directed to mail a copy of this Order, the IFP application, and PLA to Plaintiff in an envelope bearing the notation "Legal Mail" at his address of record and shall note such mailing on the docket. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal.
